In a hearing at the Delhi High Court this week, Tesla said the Indian company had continued advertising its products with the “Tesla Power” brand despite a cease-and-desist notice sent in April 2022.
Elon Musk’s automaker Tesla, has sued an Indian battery maker for infringing its trademark by using the brand name “Tesla Power” to promote its products. Tesla is seeking damages and a permanent injunction against the company from a New Delhi judge.
During the hearing, Tesla Power India Pvt Ltd, an Indian company, stated that producing “lead acid batteries” is its primary business and that producing electric automobiles is not its objective.
Laptops 1000According to the court record, the Indian firm turned over a collection of documents supporting its defense, and the judge gave it three weeks to provide a written reply.
The Indian company has been accused of utilizing the trade names “Tesla Power” and “Tesla Power USA” by Musk’s Tesla, incorporated in Delaware. A website snapshot that revealed Tesla Power USA LLC had “a solid presence in India” and was “acknowledged for being a pioneer and leader in introducing affordable batteries” was placed in the court records.
A request for comment from Tesla Power was not immediately answered.
After failing to ban the Indian business from utilizing its brand name in 2022, Tesla informed the judge that it was forced to bring the action.
The lawsuit was initiated after Musk canceled his April 21 trip to India, which was scheduled to meet with Prime Minister Narendra Modi.
Many Indian pundits referred to Musk’s unexpected travel to China a few days later as a snub, as he moved closer to implementing the company’s sophisticated driver assistance package.
On May 22, the Tesla India trademark case is scheduled to be heard again.
